Colonial Bank v. Boulder Bankcard Processing, Inc. - Indemnification agreement dispute

Our client, a credit card transaction processing service, brought an action against a bank for failure to pay its losses pursuant to an indemnification agreement.  The trial court granted our client summary judgment; the bank appealed and our client cross-appealed.  The Georgia Court of Appeals ruled in favor of our client on almost every issue, holding that the indemnity agreement required the bank to pay our client for its losses, and that our client was entitled to both prejudgment interest on damages and an award of attorney fees and expenses calculated in accordance with agreement provisions.
