Robert P. Marcovitch

Bob brings to Gaslowitz Frankel his litigation expertise, especially in the area of appellate practice. Although he has a breadth of litigation experience, he specializes in state and federal civil, and federal criminal appellate litigation, including motions practice in trial courts. With more than 21 years as a member of the bar, Bob has extensive experience as an appellate litigator, including six years in the 1990s as an Assistant U.S. Attorney in the Appellate Division of the U.S. Attorney's Office in Atlanta, several years in the late 1990's at a large law, and, most recently, as a solo practitioner focusing on appellate practice. He has written and edited countless numbers of appellate briefs, and he has also conducted oral argument in well over a dozen cases. He has also participated in the briefing and editing of major trial court motions in civil matters - including class certification and summary judgment motions - and in criminal proceedings, including motions for new trial and to suppress evidence.

Bob has an unusual breadth of legal experiences in terms of the variety of positions he has held and the subject matters of the litigations that he has handled. He has represented both plaintiffs and defendants in civil matters, he has worked as a prosecutor and as a criminal defense attorney, and he spent over four years as an in-house litigator. He has engaged in civil litigation involving will and trust disputes, real estate matters, business disputes, consumer class actions, torts, and government enforcement proceedings. Bob has also worked in virtually every subject matter area covered by the United States criminal code, including government corruption, bank robbery, bank, wire, and mail fraud, murder-for-hire, RICO, export controls, foreign corrupt practices, drugs, and money laundering.

Among Bob’s recent successes, he briefed and argued a case in the United States Court of Appeals for the Eleventh Circuit, which resulted in the reversal on behalf of his clients of a $2 million jury verdict, Tomczyk v. Jocks & Jills Restaurants, LLC, et al., Appeal No. 07-11001, 2008 WL 656073 (11th Cir. March 12, 2008); and he also wrote the winning briefs in an appeal in the Georgia Court of Appeals which resulted in the reversal of an adverse summary judgment ruling, Combs v. Atlanta Auto Auction, Inc., 287 Ga.App. 9 (2007), cert. denied (Feb 11, 2008).
